You can easily set up eSign disclosure text to ensure that signers are required to acknowledge that they agree on signing documents electronically before they view and sign the document.

Setting up eSign disclosure

Note: Only account owners and workspace admins can enable and customize eSign disclosure in Workspace defaults.

  1. Go to Settings > Workspace defaults and scroll down to eSign disclosure

  2. Switch the toggle on

  3. Make sure your company name is correct

  4. Add and customize the disclosure text. Go here for an eSign disclosure template.

  5. Select Attach disclosure to completed document if applicable, and then save your changes.

Recipient experience

Note: The eSign disclosure will not be shown to recipients who are CC'd.

When you open the document, you will first need to agree to sign documents electronically with this company.

  1. Select eSign disclosure to review the disclosure text

  2. Select the checkbox and select Agree to review and sign the document

After you agree and sign the document, the timestamp of your consent will be recorded. This timestamp will appear in both the audit trail and the signature certificate.


To review the eSign Disclosure, navigate to More actions > eSign disclosure.

What is eSign disclosure?

An eSign disclosure, or electronic disclosure, is a document provided to the signer (consumer) by the requester (business) that outlines the agreement to transmit and receive documents electronically. This document also informs the signer of their rights, such as the ability to withdraw consent and the potential consequences of doing so.

Why is eSign disclosure important?

The necessity for eSign Disclosure arises from the "Electronic Signatures in Global and National Commerce Act" (eSign Act of 2000). Section 101, subsection C of this act requires that the signer (consumer) must electronically consent in a way that clearly shows they can access information in the electronic format that will be used for the consented information.

Do I need to enable eSign disclosure?

For companies that operate on a Business to Consumer (B2C) model, enabling eSign disclosure is generally important. However, PandaDoc does not offer legal advice on this matter. We recommend consulting with your legal team to determine if eSign disclosure is necessary for your specific circumstances.

What will signers experience if eSign disclosure is enabled?

When a signer opens a signature request from you, they will see a checkbox near the Agree button. This checkbox requires them to agree to your electronic records and signature agreement. The audit trail of the original signature request will document the date and time when the checkbox was selected.
